5. Client Responsibilities

• The client is responsible for providing necessary information, access, and approvals required to execute campaigns.
• The client must ensure all content (logos, creatives, text, etc.) provided does not infringe on copyrights, trademarks, or third-party rights.
• Any delay in providing required material may impact project timelines and results.

6. Intellectual Property

All content, strategies, and creative assets developed by Pesa Wala remain our intellectual property unless otherwise agreed in writing.

Upon full payment, the client may receive rights to use specific deliverables as outlined in the contract.

7. Results & Guarantees

While we strive to achieve the best results, digital marketing outcomes cannot be guaranteed due to factors beyond our control (search engine algorithms, competition, market conditions, etc.).

We are not liable for any direct or indirect loss arising from the use of our services.

8. Confidentiality

Both parties agree to maintain confidentiality of sensitive business information exchanged during the course of services.

We may use aggregated, non-identifiable data for reporting and marketing purposes.

9. Limitation of Liability

Pesa Wala will not be held liable for any damages, losses, or disruptions resulting from the use or inability to use our services.

Our total liability will not exceed the amount paid by the client for the specific service in question.

10. Termination of Services

• Either party may terminate services by giving written notice.
• Upon termination, outstanding invoices must be settled immediately.
• Work completed until the date of termination remains chargeable.

11. Third-Party Tools & Platforms

Our services may rely on third-party platforms (Google, Facebook, Instagram, etc.). We are not responsible for changes, downtime, or disruptions caused by such third parties.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India.

Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

13. Changes to Terms

We reserve the right to update these Terms & Conditions at any time.

Continued use of our services after changes indicates your acceptance of the updated Terms.
